Welcome to www.bioclarity.com (the "Website") operated by Bio Clarity LLC, a New York limited liability company with an address at 15 Holt Drive, Stony Point, NY 10980 (“Bio Clarity”, "we", "our", or "us").  This privacy policy (this “Privacy Policy”) is intended to inform you about how Bio Clarity collects, uses and stores your personally identifiable information (“PII”) and other information in operating the Website.

How does the Website Work?

The Website enables anonymous visitors to the Website ("Visitors") to browse the Website, and Visitors who are at least eighteen (18) years of age and not a minor in their state or residence, and who register with us (“Registrants”), to purchase our products and services. The terms “you”, "your" and “yours” when used herein refer to either Registrants or Visitors, or to both Registrants and Visitors collectively, as applicable; provided that such terms will refer collectively to both Registrants and Visitors unless the context of this Agreement indicates otherwise. You can make general use of the Website without providing any PII to Bio Clarity. However, you will need to provide us or third parties with certain of your PII in order to use certain of the Website’s functionality, such as purchasing any of the products and/or services appearing on the Website or otherwise becoming a Registrant. 

By using the Website, you consent to the collection and use of your PII and other information by Bio Clarity as described in this Privacy Policy.

How can the terms of this Privacy Policy be modified?

We reserve the right to change how we handle and use the information that we collect through the Website, and to modify this Privacy Policy, at any time in our sole discretion. You agree to review this Privacy Policy periodically to be aware of all such modifications. You further agree that your continued use of the Website after a modified version of this Privacy Policy has been posted shall be deemed to be your conclusive acceptance of any modified version of this Privacy Policy. What type of PII does Bio Clarity collect from you and how do we use it?

You need to provide us with certain PII in order to use certain interactive functionality of the Website, such as making purchases or sending us certain reviews. The information we will request may include without limitation your name, address, phone number and email address. 

Bio Clarity may provide your PII to individuals or entities who work on our behalf or with us. Text Messaging Program

If you sign up for our text messaging program, cookies may be used to personalize your experience (e.g. send you personalized text messages such as shopping cart reminders).

Under what other circumstances may we release PII?

How does Bio Clarity use cookies and other tracking methods?

We may also collect anonymous and aggregate information from you about your preferences in navigating the Website by using cookies, action tags and other methods. Cookies are small text files that identify your computer. We may use cookies to, among other things, monitor usage of the Website, customize features of the Website, identify your computer operating system and browser, and complete transactions. An action tag is a small, graphic image on a webpage that is designed to allow the website owner or a third party to monitor who is visiting a website by collecting the IP address of the computer to which the tag is sent, the URL of the webpage that the tag comes from and the time at which such webpage was viewed. Do I have the ability not to be identified by Bio Clarity?

How do we store information?

Bio Clarity takes steps consistent with commercially reasonable industry standards to secure PII collected from you from loss, misuse, unauthorized access and destruction while under our control. However, please note that despite our efforts to protect information provided to us, we cannot guarantee that such information (including your PII) will not be lost, disclosed or accessed by accidental circumstances or by the unauthorized acts of others.

Does Bio Clarity provide links to other websites? 

Bio Clarity may provide links to other websites of possible interest to you. The collection and use of your PII and other information by such websites shall be subject to the policies and procedures of such websites and not those contained in this Privacy Policy. Further, the information collected by our service providers, including without limitation our e-commerce provider, in executing transactions you have requested through the Website, is subject to the privacy policies of such third parties and is not subject to this Privacy Policy.

What are our policies regarding children? 

The Website is intended for general use by persons who are above the age of thirteen (13).  The Website is not targeted to anyone under thirteen (13) years of age. Bio Clarity does not knowingly collect PII from anyone under thirteen (13) years of age. If we learn that we have unwittingly collected PII from anyone under thirteen (13) years of age, we will promptly delete such information. We endeavor to fully comply with the Children's Online Privacy Protection Act (“COPPA”), and ask that you please contact us immediately in writing if you have any concerns or questions about our COPPA compliance efforts.

What are Your California Privacy Rights?

Do we respond to Do Not Track Signals?

The Website does not have the capability to respond to “Do Not Track” signals received from various web browsers.

You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website.

Accessing and Correcting Your Information.  You can review and change your personal information by logging into our Website and visiting your account profile page. You may also send us an email at care@bioclarity.com to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you delete your User Contributions from our Website, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other Website users. Proper access and use of information provided on our Website, including User Contributions, is governed by our terms of use.

Your California Privacy Rights.  California Civil Code Section § 1798.83 permits users of our Website who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.
